- How to Enter.
No purchase is necessary to enter. To enter the Summertime Photo contest (the “Contest”), followers of @Xplornet on Facebook, Twitter and Instagram must post a photo (the “Submission”) within the theme “summertime” during the contest period commencing at 4 PM EST on Thursday, August 5th, 2021 and ending at 4 PM EST on Wednesday, August 25th, 2021 (the “Contest Period”). On Twitter, Submissions can be posted either in the comments of Xplornet’s post about the Contest, or in a separate post. If posted as a separate post, @Xplornet must be tagged in the post. On Instagram and Facebook, @Xplornet must also be tagged in any post.
Your Submission must comply with the Submission Requirements provided in paragraph 5 below. If your Submission is received during the Contest Period in accordance with these official rules and regulations (the “Rules”), as determined by the Sponsor in its sole discretion, you will be eligible to receive one (1) entry (the “Entry”) into the Contest. Limit of one Entry per person during the Contest Period.
IMPORTANT NOTE: The Contest Sponsor reserves the right at any time, in its sole and absolute discretion, to require proof, in form and substance satisfactory to the Contest Sponsor within the timeframe specified by the Contest Sponsor that: (i) confirms the entrant and the Submission meets all of the applicable requirements specified in these Rules; (ii) the entrant has all necessary permissions and authorizations as required pursuant to these Rules including permission from all persons (or from a parent or legal guardian if such person is a minor) appearing in the Submission; and/or (iii) is required for any other reason that the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules, or for any other reason. Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified may result in disqualification in the sole and absolute discretion of the Contest Sponsor. The Contest Sponsor may reproduce and/or post any Submission submitted as set forth in these Rules in any and all forms of media including its social networking pages and in a blog post as a public viewing gallery. Any Submission that the Contest Sponsor deems, at any time, violates the terms and conditions set forth in these Rules, as determined by the Contest Sponsor in its sole and absolute discretion, may be taken down.
The Contest is open to legal residents of Canada who have reached the age of majority according to the law of the province or territory in which they reside at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of Xplornet Communications Inc. (the “Sponsor”) and its affiliates, distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.
One grand prize (the “Prize”) is to be awarded consisting of a Samsung Galaxy Tab A SM-T290 (2019) 8” Tablet – Black (Approx. retail value $179.99 CAD). The Sponsor reserves the right to substitute the Prize in whole or in part for a prize of equal or greater value in the event that any component of the Prize is unavailable for any reason. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash.
- The Draw.
The winner of the Contest will be selected in a random draw conducted by Xplornet Communications Inc. of all eligible entries received during the Contest Period. The random drawing will take place at 4:30 PM EST on Thursday, August 26, 2021. The odds of winning the Prize will depend on the total number of eligible entries received during the Contest Period. The Sponsor will attempt to notify the selected entrant using the social media platform which the entrant used to enter the Contest within 7 days of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question. Before being awarded the Prize, the selected entrant will be required to complete and return, within the time stipulated by the Sponsor, a contest eligibility and liability/publicity release confirming among other things, compliance with these Rules, releasing the Sponsor and its directors, officers, shareholders and agents from all liability and, except where prohibited by law, permitting the Sponsor to publish, reproduce and/or use in any and all forms of media, the selected entrant’s name, address (city and province), photograph or other likeness, and/or his/her Submission, without further notice or compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor. Selected entrant must also provide if requested proof of identity (Driver’s License, Passport or any other government-issued photo identification). In the event that the selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after 7 business days of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsor shall have the right to select another entrant and the Sponsor shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant.
- Submission Requirements.
(a) Submissions must be original work and must not include any third party’s proprietary content, including trademarks or copyrighted content. The Sponsor in its sole and absolute discretion may disqualify any entrant who uses third party proprietary content at any time and/or edit any Submission to blur out any trademarks or to remove any copyrighted content;
(b) Submissions must not contain any reference to, or likeness of, any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence.
(c) Submissions must not include any illegal, defamatory or in any way obscene or other objectionable or inappropriate content, as determined by the Sponsor in its sole discretion. Submissions cannot be a parody or derogatory.
By entering the Contest, each entrant: (i) represents and warrants that his/her Submission is his/her original work and does not infringe on any third party’s copyright, trade-mark or other intellectual property rights; (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Submission, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Sponsor an unlimited, royalty free, irrevocable, right and license to publish, reproduce and/or use his/her Submission in any and all forms of media, including, without limitation, on the Sponsor’s social networking pages, without notice or compensation; (iv) waives all moral rights in the Submission in favour of the Sponsor; and (v) agrees to release and hold harmless the Sponsor and its directors, officers agents, representatives, successors and assigns from any claim or liability arising from or related to the Submission and/or his/her participation in this Contest. The Sponsor assumes no responsibility for any claims with respect to the Submissions.
- Privacy and Personal Information.
- Publicity of Winner’s Name.
The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above. By entering the Contest, each entrant consents to the use of his or her name, image, likeness and photographs, without compensation, in any publicity worldwide that is carried out in any media by or on behalf of the Sponsor.
- Subject to Applicable Laws.
This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. For Québec residents, any litigation respecting the conduct or organization of this Contest may be submitted to the Régie des Alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
